GENERAL TERMS & CONDITIONS

  • These terms and conditions apply to any use of the website ypnosia.com and its pages (hereinafter “Site”) and the legal relationship between the operator of the Site (“Operator”: Ypnosia Fashion Staub, based in Zurich, Switzerland) and the User.

  • The User is responsible for ensuring that the content of the data transmitted to the Operator is accurate, complies with the law and the rights of third parties and does not offend common decency.

  • The Operator accepts no responsibility for the accuracy, completeness, reliability or quality of the published or transmitted content.
  • Liability claims against the Operator, which result from the use or non-use of the information provided or the use of incorrect and incomplete information, are excluded.

  • The Operator is not responsible for direct or indirect links to external Sites.
  • The Operator has no influence on the linked sites.
  • For illegal, incorrect or incomplete contents and in particular for damages resulting from the use or non-use of such information, only the provider of the linked site is liable.

  • The Operator shall only be liable for damage resulting from access to its Site (in particular for failures, interruptions and malfunctions) if the Client can prove gross negligence.
  • The Operator shall not be liable for any deterioration in the quality of access to Ypnosia Fashion’s services in the event of force majeure or events beyond the Operator’s control, in particular in the event of failure of the communication network.

  • The exclusive place of jurisdiction for all disputes arising between the Operator and the User is Zurich, Switzerland.
  • The legal relationship between the Operator and the User is subject to Swiss law.

  • All orders placed by the customer via the Site are subject exclusively to the general terms and conditions set out below, which are valid at the time the order is placed.
  • We do not accept any other terms and conditions of the customer.

  • The languages available for contracts are English and German.
  • The presentation of items on our Site does not constitute an offer by Ypnosia Fashion to enter into a contract of sale.
  • The products available in our online boutique are merchandised using digital image representations of actual items. Minor differences may occur as a result of this process, but these cannot in any way be considered as product defects.
  • By sending us the order form provided on our Site, you are making a binding offer to enter into a contract of sale with us. You make an offer by entering all the required information during the ordering process and submitting the order form.
  • You will be given the opportunity to check your details and correct any errors before submitting your offer.
  • On receipt of your order we will send you an order confirmation. Please note that our order confirmation does not constitute acceptance of your offer to enter into a contract, but is for information purposes only.
  • The sales contract between you and Ypnosia Fashion only comes into effect once we have accepted the offer by dispatching the products ordered. The products will not be dispatched until the full amount has been credited to our account.
  • The delivered products remain our property until the purchase price has been paid in full.
  • Ypnosia Fashion has the right to refuse any offer without giving reasons, in particular if there are reasonable grounds to suspect that the items purchased via the Internet are intended for resale on a commercial basis.

Data protection

    • Data protection is part of our customers’ right to privacy; we take this issue very seriously and only retain the information that is essential for our customer care and service. We operate in accordance with the E-Commerce Code of Ethics issued by the ASVPC (Swiss Association of E-Commerce Merchants).
    • When creating an account, we ask our customers to provide personal information such as first and last name, e-mail address, postal address and telephone number. Fields marked with an asterisk are required to process orders. We cannot process orders without this information.
    • None of the information is shared with third parties except for our service partners who need the information to process orders, payments and deliveries. They have no right to use the information for their own purposes. The flow of information is therefore kept to a minimum.

Use of cookies

    • Ypnosia Fashion uses session cookies. Their sole purpose is to record the customer’s transactions, facilitate further visits to our site and future orders by allowing us to tailor our offer to the customer’s preferences.

Google Analytics

    • Ypnosia Fashion uses Google Analytics to compile anonymous reports on the activity of users of the Ypnosia Fashion online boutique. Google Analytics is a tool that is only used for internal market analysis, as we want to adapt our Site services to the needs of our customers.

Social Plugins

    • Ypnosia Fashion may use social plugins. Social plugins are special tools that allow the integration of social network functions directly on our site (e.g. the “Like” button on Facebook).
    • All social plugins on our Site are identified by the logos of the relevant social network.
